The services provided by MoCapOnline.com (www.motioncaptureonline.com or www.motusdigital.com) can be used by anyone, if the terms of service are respected. You should also read our terms and conditions (“terms”) carefully before using this website and its services. Using our websites (the “Website”) indicates that you accept these terms below regardless of whether or not you choose to register with us. If you do not accept these terms, do not use the website.
Introduction
We offer animation packs for sale to both individuals and businesses. The packs are delivered in a variety of formats for multiple game engines and animation environments.
You may access the pages and information on the Website without registering your details with us. Should you buy something through our store or register for our newsletter, you shall be deemed to have accepted these Terms in full by registering your information. We may update the Terms at any time and recommend checking for updates periodically or when notified of such updates by email.
Confidentiality
We collect just the amount of personal information that is needed to create and maintain your account. Users can access and update personal information in the My Account section. We will neither disclose your personal information, nor sell it to anyone. Your IP, personal information and received data are confidential and will never be released, except by request from authorities. We always include an opt-out method to our direct marketing messages.

This privacy notice is to let you know how MoCapOnline.com looks after your personal information. This includes what you tell us about yourself, what we learn by having you as a customer, and the choices you give us about what marketing/notifications you want us to send you. This notice explains how we do this and tells you about your privacy rights and how the law protects you.
Our Privacy policy is to keep your data safe and private, not to sell your data and to give you ways to manage and review your existing data and marketing/notification choices at any time.
Data protection law says that we are allowed to use personally identifiable information (PII) only if we have a proper reason to do so. Our main scope of collecting and processing the provided PII is to be able to fulfill a contract we have with you. MoCapOnline.com performs profiling, with the purpose of offering its customers the features considered most suitable for them. As a hypothetical example, we would not want to bother our Unity customers with notices of changes/updates or sales specific to our Unreal packs. They wouldn’t be interested because the notices do not apply to them. This is what we mean when we talk about ‘marketing’. The outcome of any such profiling is not shared with third parties. If customers wish not to be profiled and not to receive any or specific types of emails, they must change their Email Preferences, which can be found after logging in to the service, under MyAccount → Account Details.
In addition to field data entered by purchasers or queries to our help desk function, MoCapOnline.com collects the browser type and the IP address of the person who buys or submits their information. This is done anonymously, only for statistical & debugging reasons, and is not used to identify individuals, nor is this data shared with third parties.
We can only use your personal information to send you marketing messages if we have either your consent or a “legitimate interest.” A legitimate interest is when we have a business or commercial reason to use your information. An example of our legitimate interest is to notify you that an update has been made available to a pack you own. Our interest must not unfairly go against what is right and best for you. You can ask us to stop sending you marketing messages by contacting us at any time or changing your email preferences, under your MyAccount → Account Details → Email preferences.
Whatever email preferences you choose, you'll still receive system notifications and statements or other important information such as changes to your existing products and services. Such notifications cannot be stopped as will interfere with contractual obligations both parties have assumed.
USE OF COOKIES & DISPLAY ADVERTISING
We collect non-personally identifiable data for two reasons: first, to process your order; and second, to provide you with the best and most customized service possible. The non-personally identifiable data includes "cookies", which are small text files stored on your computer when you browse a website, allowing it to recognize a returning visitor.
MoCapOnline.com has implemented and is using third-party vendors like Google Analytics for Display Advertisers (e.g. remarketing). We display content-specific advertisements to those who have previously visited our website when they visit other websites that have the Google Display Network implemented. For this purpose, we use cookies (such as the Google Analytics cookie) and third-party cookies (such as the DoubleClick cookie) to inform, optimize, and serve ads based on someone's past visits to our website. These non-personally identifiable cookies collect traffic data such as the source, medium and keyword(s) for referred traffic. Visitors can opt-out of Google Analytics for Display Advertising and customize Google Display Network ads using the Google Ads Preferences Manager. If you would like to opt out, you may use this browser add-on.

HOW LONG WE KEEP YOUR PERSONAL INFORMATION
MoCapOnline.com accounts do not expire. When MoCapOnline.com receives a complete account deletion request from a customer, MoCapOnline.com will delete the customer data and the collected data from all of its systems within 60 days unless retention obligations apply.
HOW TO WITHDRAW YOUR CONSENT
You can withdraw your consent at any time. Please contact us if you want to do so. If you withdraw your consent, we may not be able to provide certain products or services to you. If this is the case, we will tell you.

Please let us know if you are unhappy with how we have used your PII. The website and its services comply with applicable privacy laws and we are making efforts to adjust for the specific requirements of other markets. Disputes arising in connection with these terms shall be subject to the exclusive jurisdiction of Dallas, Texas courts. Motus Digital, LLC. is subject to oversight by the U.S. Federal Trade Commission. JAMS is the US-based independent organization responsible for reviewing and resolving complaints about our compliance with the principles of Privacy Shield. We ask that you first submit any such complaints directly to us via privacy@MotusDigital.com. Visiting our websites from outside the United States.
If you are accessing our Services from outside the United States, please be aware that your information may be transferred to, stored, and processed in the United States where our servers are located and our central database is operated. This Policy and the storage, use and disclosure of your information under this Policy, is governed by the laws on the United States. The Services are controlled and operated by Motus Digital, LLc. from the United States and you expressly waive the application of any laws of any territory other than the United States. The data protection and other laws of the United States and other countries might not be as comprehensive as those in your country. By using our Services, you understand and agree that your information may be transferred to our facilities and those third parties with whom we share it as described in this Policy, and the laws of the United States apply to the use, storage and disclosure of your information.
Security
Submissions are stored securely on our Amazon hosted servers, and are protected against misuse, interference and loss, as well as from unauthorized access, modification and disclosure.
We take reasonable security measures (including physical, electronic and procedural measures) intended to help safeguard your personal information from unauthorized access and disclosure. For example, only authorized employees, contractors, and service providers are permitted to access personal information, and they may do so only for permitted business functions. In addition, we use firewalls to help prevent unauthorized persons from gaining access to your personal information.
We want you to feel confident using our Services to transact business. However, no system can be completely secure. Therefore, although we take steps to secure your information, we do not promise, and you should not expect, that your personal information, or searches, or other information will always remain secure. Please be advised that whenever you voluntarily disclose personal information on publicly-viewable web pages, that information will be publicly available and can be collected and used by others. We do not allow services to be used for activities related to or promoting racism, segregation, religious hatred or any illegal activities. We will delete any account that violates these terms.
Anti-spam policy
We are totally against spam. We only want to be of service to our customers and those interested in Animation and Motus Digital, LLC. If you are not interested, please change your email preferences or just let us know.
Children's Privacy
Our Services are for a general audience and are not directed to or intended for children under the age of 16. Accordingly, we do not knowingly collect personal information from children under the age of 16 and if we become aware that we have, we will promptly delete such information from our servers.
Changes
If we are involved in a reorganization, merger, acquisition, or sale of our assets, your information may be transferred as part of that deal. We will notify you (for example, via a message to the email address associated with your account) of any such deal and outline your choices in that event. We may revise this Privacy Policy from time to time, and will post the most current version on our website. If a revision meaningfully reduces your rights, we will notify you.
