Motus Digital - Privacy Statement

This privacy policy explains how MoCap Online (mocaponline.com), operated by Motus Digital, LLC, collects, uses, and protects your personal information. We sell professional motion capture animation packs for game developers and animators. We are committed to keeping your data safe, never selling it, and giving you control over your information and marketing preferences.

By using our website, you accept the terms below. Please also read our Terms of Service and our Standard License and Commercial License agreements.

Introduction

We offer animation packs for sale to both individuals and businesses. Our packs are delivered in a variety of formats for multiple game engines and animation environments, including FBX, BIP, Unreal Engine, Unity, iClone, and Blender.

You may access the pages and information on the Website without registering your details with us. Should you buy something through our store or register for our newsletter, you shall be deemed to have accepted these Terms in full by registering your information. We may update the Terms at any time and recommend checking for updates periodically or when notified by email.

Confidentiality

We collect just the amount of personal information needed to create and maintain your account. Users can access and update personal information in the My Account section. We will neither disclose your personal information, nor sell it to anyone. Your IP, personal information and received data are confidential and will never be released, except by request from authorities. We always include an opt-out method in our direct marketing messages.

Data Privacy

This privacy notice explains how MoCap Online looks after your personal information. This includes what you tell us about yourself, what we learn by having you as a customer, and the choices you give us about what marketing and notifications you want us to send you. This notice explains how we do this and tells you about your privacy rights and how the law protects you.

MoCap Online performs profiling with the purpose of offering customers the features most suitable for them. For example, we would not send Unity customers notices about Unreal-specific updates. The outcome of any such profiling is not shared with third parties. If you wish not to be profiled or not to receive specific types of emails, change your Email Preferences under MyAccount → Account Details.

In addition to field data entered by purchasers or queries to our help desk, we collect the browser type and IP address of visitors. This is done anonymously, only for statistical and debugging reasons, and is not used to identify individuals or shared with third parties.

We can only use your personal information to send marketing messages if we have either your consent or a "legitimate interest." A legitimate interest is when we have a business or commercial reason to use your information, such as notifying you that an update has been made to a pack you own. You can ask us to stop sending marketing messages by contacting us at any time or changing your email preferences under MyAccount → Account Details → Email preferences.

Regardless of your email preferences, you will still receive system notifications and important information such as changes to your existing products and services. Such notifications cannot be stopped as they relate to contractual obligations.

Use of Cookies and Display Advertising

We collect non-personally identifiable data for two reasons: to process your order and to provide you with the best service possible. This includes "cookies," which are small text files stored on your computer when you browse a website.

MoCap Online uses third-party vendors like Google Analytics for Display Advertisers, including remarketing. We display content-specific advertisements to previous visitors when they visit other websites on the Google Display Network. For this purpose, we use cookies (such as the Google Analytics cookie) and third-party cookies (such as the DoubleClick cookie) to inform, optimize, and serve ads based on past visits. Visitors can opt-out of Google Analytics for Display Advertising and customize Google Display Network ads using the Google Analytics Opt-out Browser Add-on.

How Long We Keep Your Personal Information

MoCap Online accounts do not expire. When we receive a complete account deletion request, we will delete the customer data from all of our systems within 60 days unless retention obligations apply.

How to Withdraw Your Consent

You can withdraw your consent at any time. Please contact us if you want to do so. If you withdraw your consent, we may not be able to provide certain products or services to you.

Your Right to Complain

Please let us know if you are unhappy with how we have used your personal information. The website and its services comply with applicable privacy laws and we are making efforts to adjust for specific requirements of other markets.

These terms shall be governed by and construed in accordance with United States law. Disputes arising in connection with these terms shall be subject to the exclusive jurisdiction of Dallas, Texas courts. Motus Digital, LLC is subject to oversight by the U.S. Federal Trade Commission. JAMS is the US-based independent organization responsible for reviewing and resolving complaints about our compliance with the principles of Privacy Shield. We ask that you first submit any such complaints directly to us via privacy@MotusDigital.com. If you are not satisfied with our response, please contact JAMS EU-US Privacy Shield or the EU Data Protection Agency.

Visiting Our Website from Outside the United States

If you are accessing our Services from outside the United States, please be aware that your information may be transferred to, stored, and processed in the United States where our servers are located. This Policy and the storage, use and disclosure of your information under this Policy is governed by the laws of the United States. By using our Services, you understand and agree that your information may be transferred to our facilities and those third parties with whom we share it as described in this Policy.

Submissions are stored securely on our Amazon-hosted servers and are protected against misuse, interference, loss, unauthorized access, modification, and disclosure.

We take reasonable security measures (including physical, electronic, and procedural measures) to help safeguard your personal information from unauthorized access and disclosure. Only authorized employees, contractors, and service providers are permitted to access personal information, and they may do so only for permitted business functions. We use firewalls to help prevent unauthorized persons from gaining access to your personal information.

We want you to feel confident using our Services. However, no system can be completely secure. Although we take steps to secure your information, we do not promise that your personal information, searches, or other information will always remain secure. We do not allow services to be used for activities related to or promoting racism, segregation, religious hatred, or any illegal activities. We will delete any account that violates these terms.

Children's Privacy

Our Services are for a general audience and are not directed to or intended for children under the age of 16. We do not knowingly collect personal information from children under 16. If we become aware that we have, we will promptly delete such information from our servers.

If we are involved in a reorganization, merger, acquisition, or sale of our assets, your information may be transferred as part of that deal. If a revision meaningfully reduces your rights, we will notify you.
